This entitlement applies to:<\/p><ul data-start=\"788\" data-end=\"940\"><li data-start=\"788\" data-end=\"825\"><p data-start=\"790\" data-end=\"825\">Full-time and part-time employees<\/p><\/li><li data-start=\"826\" data-end=\"874\"><p data-start=\"828\" data-end=\"874\">Those with permanent or fixed-term contracts<\/p><\/li><li data-start=\"875\" data-end=\"940\"><p data-start=\"877\" data-end=\"940\">Employees regardless of job role, working hours, or seniority<\/p><\/li><\/ul><p data-start=\"942\" data-end=\"1152\">This right is governed by the <strong data-start=\"972\" data-end=\"994\">Chilean Labor Code<\/strong>, which establishes that the employee&rsquo;s obligation to work is suspended during the leave period, while the employer remains responsible for full wage payment.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7c46473 elementor-widget elementor-widget-heading\" data-id=\"7c46473\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Taking a holiday leave<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-06da0e6 elementor-widget elementor-widget-text-editor\" data-id=\"06da0e6\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p data-start=\"1006\" data-end=\"1425\">To request their annual paid leave, employees must submit a formal request to their employer. The timing of the leave is generally agreed upon between both parties, but the employer cannot unilaterally impose vacation dates\u2014except in the case of a collective company closure of at least 15 working days, in which all employees must take their vacation simultaneously, even if they haven\u2019t completed a full year.<\/p><p data-start=\"1427\" data-end=\"1780\">The employee cannot demand leave before completing the 12-month requirement. However, employers may voluntarily grant leave in advance. Once the leave is approved, the employer must continue paying the employee\u2019s full salary during the absence, calculated as the fixed salary or an average of the past three months for variable compensation.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-78cc80d elementor-widget elementor-widget-heading\" data-id=\"78cc80d\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Vacation in Installments<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7e8fb92 elementor-widget elementor-widget-text-editor\" data-id=\"7e8fb92\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Under <strong>Article 70<\/strong>, at least 10 days must be taken consecutively. The remaining 5 can be split or postponed by agreement between the employer and the employee.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d9399f0 elementor-widget elementor-widget-text-editor\" data-id=\"d9399f0\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><strong>Relevant Law \u2013 Article 70 of the Chilean Labor Code<\/strong>:<\/p><p><em>\u00ab\u00a0The vacation must be continuous, but the portion exceeding 10 working days may be split by mutual agreement\u00a0\u00bb<\/em><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b6d4e61 elementor-widget elementor-widget-heading\" data-id=\"b6d4e61\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Carrying Over and Selling Annual Leave<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e58b51b elementor-widget elementor-widget-heading\" data-id=\"e58b51b\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Carrying Over Vacation Days<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a82ed11 elementor-widget elementor-widget-text-editor\" data-id=\"a82ed11\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p data-start=\"3760\" data-end=\"3897\">In Chile, employees can carry over unused vacation days, but only up to two consecutive periods. This means if an employee does not take their 15 working days of annual leave in a given year, they may accumulate them with the next year&rsquo;s entitlement. However, once this two-year limit is exceeded, the employer is obligated to ensure the employee takes the accumulated vacation before a new entitlement cycle begins.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4c88ab0 elementor-widget elementor-widget-heading\" data-id=\"4c88ab0\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Selling Annual Leave<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1d1d006 elementor-widget elementor-widget-text-editor\" data-id=\"1d1d006\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p data-start=\"3760\" data-end=\"3897\">However, Chilean labor law does not permit the sale or monetary compensation of unused vacation days as a replacement for actual time off. Annual leave must be used for real and effective rest. The only exceptions to this rule apply upon termination of the employment contract, where the employer must compensate the employee for both accrued and proportional vacation days not yet taken.
