When choosing to expand in Brazil or to hire Brazilian with local contracts, a business must have adequate knowledge of the laws but also local customs. This also applies to labor laws and, more precisely, to termination rules and regulations.<\/p><p>In theory, employment in Brazil can be terminated at any time, with or without cause, provided the employer follows rules for notice periods. But in practice, it\u2019s somehow a little different!<\/p><p>Let\u2019s have a look at terminations in Brazil and discover what are the local laws and customs \u2b07\ufe0f<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6c8528c elementor-widget elementor-widget-heading\" data-id=\"6c8528c\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">End of employment and types of termination in Brazil <\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-24ab1cb elementor-widget elementor-widget-heading\" data-id=\"24ab1cb\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Termination with cause<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9e4f1f8 elementor-widget elementor-widget-text-editor\" data-id=\"9e4f1f8\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Brazil follows at-will termination practices. It means that, once hired and under contract, any party may terminate the contract without cause upon the mandatory prior notice and payment of the severance. The article 482 of the Brazilian Labor Law (CLT) enable businesses to terminate their employee with cause for some reasons including :<\/p><ul><li style=\"list-style-type: none;\"><ul><li style=\"list-style-type: none;\"><ul><li>improbity (e.g., fraud);<\/li><li>impropriety;<\/li><li>business dealings by the employee for his\/ her own or someone else\u2019s benefit without permission of the employer;<\/li><li>competition with the employer;<\/li><li>criminal conviction (final decision);<\/li><li>negligence in the performance of his\/her duties;<\/li><li>drunkenness, either habitual or at work;<\/li><li>breach of confidentiality by the employee;<\/li><li>insubordination or indiscipline;<\/li><li>the employee abandons his work;<\/li><li>libel, slander and any other defamation acts, exercised at worksite by the employee, against any person, or physical acts of offence under the same conditions, except in the case of self-defense or defense of third parties;<\/li><li>libel, slander, any other defamation acts or physical acts of offence exercised by the employee against the employer and hierarchical superiors, except in the case of self-defense or defense third parties;<\/li><li>frequent gambling;<\/li><li>loss of qualification or of the requirements established in law for the exercise of the profession, as a result of willful misconduct of the employee.<\/li><\/ul><\/li><\/ul><\/li><\/ul><p>In theory, a business has the possibility to terminate his employee with cause.<strong> However, in practice, it is hardly impossible to terminate an employee with cause in Brazil<\/strong>. Brazilian Labor laws is extremely employee-friendly and courts tend to favor employee.<\/p><p>As a matter of fact, most employee terminated with cause will choose to go to the court and, in most cases, they will win the case.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-03eaf37 elementor-widget elementor-widget-heading\" data-id=\"03eaf37\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Termination without cause<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fb96101 elementor-widget elementor-widget-text-editor\" data-id=\"fb96101\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Termination without cause is the most common type of termination employees face in Brazil. However, some employees are protected and can not be dismissed without cause:<\/p><ol><li style=\"list-style-type: none;\"><ol><li>Pregnant employees on maternity leave and after birth are protected against dismissal without cause. She enjoys absolute protection from the date the pregnancy is confirmed until five months after giving birth to the child;<\/li><li>Employees who had a work-related accident and prevented from attending work for at least 15 days are protected against termination without cause. They cannot be dismissed without cause for a period of one year, counted from the date the employee returns to work.<\/li><li>Union leader from the date when his \/ her candidacy is registered until 12 months after the end of his \/ her term; and<\/li><li>an employee elected president of the internal commission for accident prevention cannot be dismissed without cause from the date he \/ she registers to run for the position until one year after the end of his \/ her tenure.<\/li><li>Employee who is one year away from retiring<\/li><\/ol><\/li><\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-da37076 elementor-widget elementor-widget-heading\" data-id=\"da37076\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Mutual agreement<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-57418aa elementor-widget elementor-widget-text-editor\" data-id=\"57418aa\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Termination by mutual agreement is quite new in Brazil. Mutual agreement is used when there is mutual interest. It can not be imposed on any of the parties.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-aeabe3a elementor-widget elementor-widget-heading\" data-id=\"aeabe3a\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Resignation<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c0136bf elementor-widget elementor-widget-text-editor\" data-id=\"c0136bf\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Terminations by resignation are straight forward terms and do not pose complex issues under Brazilian Labor laws. Employees can resign at any time, without cause.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f965312 elementor-widget elementor-widget-heading\" data-id=\"f965312\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Termination during trial period<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b399c21 elementor-widget elementor-widget-text-editor\" data-id=\"b399c21\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Employers and employee can terminate employment during the trial period however, the party deciding to end the employment contract will have to pay a fine to the other party.\u00a0<\/p><p>The fine is equal to 50%\u00a0of remuneration calculated on the days remaining until the end of the contract.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4e09438 elementor-widget elementor-widget-text-editor\" data-id=\"4e09438\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Eligibility for severance pay in Brazil depends on the nature of the employment contract and the reason for termination. Employees who work under a formal CLT contract are generally entitled to severance benefits, especially in cases of termination without just cause. If the employer is terminating employees, the formal letter of termination would be the first document to send.\u00a0<\/p><p>Employers must fill out and get employees to sign the following documents upon termination:<\/p><ol><li style=\"list-style-type: none;\"><ol><li style=\"list-style-type: none;\"><ol><li>The letter of termination<\/li><li>Aviso pr\u00e9vio \u2013 termination notice letter<\/li><li>Termo de Rescisao de Contrato de Trabalho (TRCT) \u2013 termination of employment contract terms<\/li><li>Guia de Recolhimento Rescisorio do FGTS (GRRF) \u2013 form that is utilized to withdraw funds from FGTS<\/li><li>Seguro Desemprego \u2013 unemployment insurance benefit<\/li><\/ol><\/li><\/ol><\/li><\/ol><p>The employer will also have to schedule a mandatory medical examination <em>(*)<\/em> with a certified doctor. This is to check any possible work-related disease that could prevent a termination without cause.<\/p><p>Interview with the employee is always recommended. However, this is not mandatory by law.\u00a0<\/p><p><em>(*) If the termination occurs during the first three months, the exit medical exam is not mandatory.<\/em><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-50abe39 elementor-widget elementor-widget-heading\" data-id=\"50abe39\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Mutual agreement<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-48eb6c2 elementor-widget elementor-widget-text-editor\" data-id=\"48eb6c2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>When both parties decide to terminate the employment contract by mutual agreement, they must follow the following process:\u00a0<\/p><p>The employer or employee must send the termination letter. The termination letter must be handwritten if the employee sends it. This letter must contain: the type of notice and specify that the employee and employer agree to the termination of the employment relationship by consensus, always following the rules set out in article 484-A.<\/p><p>Another important point is that, in order for this agreement to be properly formalized, witnesses must be present so that there is no manipulation or coercion on either side.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4999ac7 elementor-widget elementor-widget-heading\" data-id=\"4999ac7\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Resignation <\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-eb07fb7 elementor-widget elementor-widget-text-editor\" data-id=\"eb07fb7\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Resignation process is quite simple in Brazil.
